How to Claim Compensation When a Passenger Dies in a Car Crash

Losing a loved one in a car accident is devastating—especially when the loss was preventable. If a passenger is killed in a crash, surviving family members may be entitled to pursue a wrongful death claim against the at-fault party or parties.

Who Can File a Wrongful Death Claim?

In California, certain close relatives—such as a spouse, children, or, in some cases, parents—may be eligible to seek compensation for:

  • Funeral and burial expenses
  • Loss of companionship and support
  • Lost future income and benefits
  • Medical bills related to the accident

Determining Liability

Even if your loved one was not driving, they still have legal rights. Liability may fall on:

  • The driver of the vehicle your loved one was in
  • Another motorist involved in the crash
  • A commercial entity or government agency, depending on circumstances

To determine liability and build a strong case, it’s essential to work with experienced wrongful death attorneys who understand California’s complex laws.
