How to Get Compensation After a Fatal Pedestrian Hit-and-Run

Losing a loved one in a pedestrian hit-and-run accident is a devastating experience—emotionally and financially. If someone in your family was fatally struck by a fleeing driver, you may be entitled to compensation. However, the legal process can be complex, especially when the responsible party is unknown or has not yet been apprehended.

In these cases, working with experienced pedestrian accident attorneys can make all the difference in seeking justice and financial recovery.

Legal Options After a Fatal Hit-and-Run

Victims’ families often feel powerless when a hit-and-run driver escapes the scene. However, there are still several potential paths to compensation:

  1. Uninsured Motorist Coverage
If your loved one had auto insurance with uninsured/underinsured motorist (UM/UIM) coverage—or if a household member did—this may provide benefits even when the at-fault driver is not found.
  2. Crime Victims Compensation Board
California offers financial assistance to victims of violent crimes, including hit-and-runs. This can cover medical bills, funeral costs, and certain other losses.
  3. Civil Lawsuit if the Driver is Found
If law enforcement identifies the driver, a wrongful death lawsuit may be filed. A skilled hit and run accident attorney can help you build a strong case for damages, which may include funeral expenses, lost financial support, and loss of companionship.
  4. Third-Party Liability
In some cases, other parties may share responsibility, such as vehicle manufacturers, government entities (for unsafe road design), or employers if the driver was on the job. A knowledgeable Los Angeles car accident attorney can explore all possible avenues for recovery.
