San Diego, California – Authorities have identified 35-year-old Marco Quintero of San Diego as the bicyclist who was killed after being struck by a pickup truck in Lemon Grove on Sunday night.

The crash occurred shortly before 9:30 p.m. in the 8500 block of Troy Street, just east of Camino De Las Palmas, according to the San Diego County Medical Examiner’s Office and the Sheriff’s Department.

Quintero was riding his bicycle when a black Chevrolet Silverado hit him. Paramedics responded to the scene and transported him to Scripps Mercy Hospital in Hillcrest, where he was pronounced dead shortly after arrival.

Compensation Options When a Cyclist Is Killed by a Car in California

When a cyclist is tragically killed in a car accident, surviving family members may be entitled to pursue financial compensation for their loss. In California, the law allows victims’ families to hold negligent drivers accountable through a wrongful death claim. Understanding your legal rights and the types of compensation available can help you navigate this difficult process.

Understanding Wrongful Death Claims in California

A wrongful death claim is a civil lawsuit filed when a person dies as the result of another party’s negligence or misconduct. In bicycle accidents, wrongful death cases often arise when a driver fails to yield, speeds, drives distracted, or otherwise violates traffic laws.

By filing a claim with experienced wrongful death attorneys, families can seek compensation for:

  • Funeral and burial expenses
  • Lost income and financial support
  • Medical costs incurred before death
  • Pain and suffering
  • Loss of companionship and guidance

How Bicycle Accident Attorneys Can Help

After a fatal bicycle crash, determining fault and building a strong case requires expertise. Skilled bicycle accident attorneys can investigate the scene, obtain traffic camera footage, interview witnesses, and work with accident reconstruction experts to prove negligence.

In many cases, cyclists are hit by distracted or speeding drivers who fail to notice them on the road. Even when law enforcement determines there was no criminal intent, the family still has the right to pursue civil compensation for damages.

Compensation in Fatal Bicycle Accidents

California law allows both economic and non-economic damages in wrongful death claims. Economic damages cover measurable losses like income and medical bills, while non-economic damages compensate for emotional suffering and loss of companionship.

Families may also file a survival action, which allows recovery for pain, suffering, or expenses the victim endured before passing away.
