[10-09-2025] San Diego County, CA – Pedestrian Accident in Chula Vista Leaves 77-year-old Man Dead

Chula Vista, California – A 77-year-old man was killed early Wednesday morning after being struck by a vehicle while walking in Chula Vista, authorities said.

The collision occurred around 6:30 a.m. in the 600 block of L Street, when an eastbound 2014 Toyota Corolla hit the man as he was in the roadway, according to the Chula Vista Police Department.

Despite efforts to assist him, the pedestrian died at the scene, Officer Carson Tabor reported. His name has not yet been released pending notification of family members.

Police said it remains unclear who was at fault for the accident. However, investigators do not believe that intoxication played a role in the fatal crash.

The incident is under investigation by the Chula Vista Police Department’s Traffic Bureau.

How to Determine Liability After a Pedestrian Accident in California

When a pedestrian accident occurs, determining who is at fault is often one of the most complex and important parts of a personal injury claim. California law allows victims to pursue compensation if another party’s negligence caused the collision, but proving liability requires strong evidence and legal guidance from experienced pedestrian accident attorneys.

1. Understanding Pedestrian Right-of-Way Laws

California’s Vehicle Code gives pedestrians the right of way in marked and unmarked crosswalks. However, this doesn’t mean drivers are always automatically at fault. Investigators examine whether the pedestrian crossed against a signal, entered the road unexpectedly, or was distracted. Likewise, drivers can be found negligent for speeding, failing to yield, running red lights, or driving while distracted.

2. Gathering Evidence to Establish Fault

Liability is determined based on facts gathered from the accident scene, including:

  • Police and accident reports
  • Eyewitness statements
  • Surveillance or traffic camera footage
  • Vehicle damage and skid marks
  • Cell phone or GPS records (to prove distraction or speed)

An experienced attorney will analyze this evidence to identify who caused or contributed to the crash.

3. Shared Fault and Comparative Negligence

California follows a pure comparative negligence system, meaning multiple parties can share responsibility for an accident. Even if a pedestrian is partially at fault—for example, crossing outside a crosswalk—they can still recover compensation, though their award is reduced by their percentage of fault. A skilled legal team can help minimize your share of liability and maximize your recovery.

4. When a Pedestrian Accident Leads to Death

If a pedestrian is killed, their family may pursue a claim with the help of wrongful death attorneys. These claims can provide financial relief for funeral costs, loss of companionship, and future income. Proving negligence in these cases often requires expert testimony and accident reconstruction to determine how and why the fatal crash occurred.
