Can a Pedestrian Claim Compensation From the Driver Who Hit Them?

Yes. If a pedestrian is struck by a negligent driver, they have the right to file a claim or lawsuit to recover compensation for their injuries, medical expenses, lost wages, and pain and suffering. Under California law, drivers owe a duty of care to everyone on the road — including pedestrians. When that duty is breached through speeding, distraction, or failure to yield, victims can pursue damages with the help of an experienced pedestrian accident lawyer in California.

An established car accident law firm can investigate the collision, gather key evidence such as video footage or witness statements, and negotiate directly with insurance companies to secure fair compensation. In some cases, a Los Angeles car accident attorney may also help file a personal injury lawsuit if settlement offers are insufficient. If you were hit by a car while walking, don’t face the process alone.
