Can You Claim Compensation After a Pedestrian Is Killed in a Hit-and-Run?
Yes, you may be eligible to claim compensation if a loved one was killed as a pedestrian in a hit-and-run accident in California. While these cases are emotionally devastating and legally complex, state law allows surviving family members to pursue a wrongful death claim—even when the driver responsible flees the scene.
Legal Options for Surviving Family Members
When a pedestrian is fatally struck in a hit-and-run, multiple legal avenues may be available:
- Wrongful Death Claim: You may file a lawsuit for damages such as funeral costs, loss of financial support, and emotional suffering. Our experienced wrongful death attorneys can help you determine eligibility and build a strong case.
- Uninsured Motorist Coverage: If the at-fault driver is never identified, you may be able to recover compensation through the deceased’s or a family member’s auto insurance policy under the uninsured motorist clause.
- Crime Victim Compensation: California offers financial assistance to victims of crimes, including hit-and-runs involving death. A pedestrian accident attorney can help you apply for this program.
- Civil Lawsuit Against Third Parties: In rare cases, liability may extend to other parties, such as a negligent property owner or municipality if dangerous road conditions contributed to the fatal crash.
