Can Families Sue for Compensation After a Fatal Pedestrian Hit-and-Run?
Yes, families in California can file a wrongful death claim if a loved one is killed in a pedestrian hit-and-run accident. Under California law, surviving family members β such as a spouse, children, or dependents β have the right to seek compensation for medical expenses, funeral costs, lost financial support, and emotional suffering.
Even if the driver fled the scene, families may still be eligible for financial recovery. If the at-fault driver is later identified and arrested, they can be held civilly and criminally liable. In some cases, families may also be able to recover damages through uninsured motorist coverage or a victim compensation fund.
To pursue this type of legal action, itβs critical to work with experienced wrongful death attorneys who understand the complexities of hit and run accident claims and pedestrian accident cases.
