Can You Claim Compensation if a Family Member Died and Others Were Injured in the Same Accident?

Yes, you can claim compensation if a family member died and others were injured in the same accident. In California, these cases often involve two separate but related claims: a wrongful death claim for the deceased victim, and personal injury claims for the surviving relatives who were hurt.

1. Wrongful Death Claims

Family members such as a spouse, children, or parents may pursue financial recovery through a wrongful death attorney in California. This claim can include compensation for loss of companionship, emotional distress, funeral costs, and the financial support the deceased would have provided.

2. Personal Injury Claims for Surviving Relatives

In the same incident, injured family members may also seek damages through personal injury claims. A catastrophic injuries attorney can help recover compensation for medical expenses, rehabilitation, pain and suffering, and lost income. Each injury claim is treated independently but can proceed alongside the wrongful death case.

3. Pedestrian or Vehicle-Related Accidents

If the crash involved pedestrians or occurred on public roads, an experienced pedestrian accident lawyer in California can help investigate liability and gather evidence. For collisions in San Diego County or nearby areas, it’s crucial to work with seasoned San Diego car accident attorneys who understand local traffic laws and court procedures.
