Bakersfield, Kern County – Authorities believe alcohol and/or drugs may have contributed to a deadly collision early Saturday morning on Highway 58, where one person lost their life. A GoFundMe has been launched to support the family of the passenger who died.

According to the California Highway Patrol (CHP), the crash happened around 3:43 a.m. on Saturday, April 26, 2025. Officers responded to a call about a two-vehicle accident on Highway 58 near Bena Road.

The preliminary investigation revealed that a 2002 Mazda pickup truck was heading eastbound on Highway 58, just west of Bena Road, traveling at approximately 70 to 75 miles per hour in the number two lane. The Mazda was approaching a 2016 Freightliner semi-truck with a trailer, which was moving uphill at around 35 miles per hour in the same lane.

As the Mazda neared the slower-moving Freightliner, it was unable to slow down in time and collided with the rear of the trailer.

The driver of the Mazda suffered moderate injuries and was transported to Kern Medical for treatment. Tragically, the passenger, later identified as 18-year-old Abram Perez, was pronounced dead at the scene.

The driver of the Freightliner remained at the crash site and fully cooperated with investigators.

CHP officials confirmed that alcohol and/or drug use is considered a factor in the collision.

How to Claim Compensation When Someone Dies in a Car Crash

Losing a loved one in a car accident is devastating. In addition to emotional pain, families are often left facing financial burdens. If someone else’s negligence caused the crash, you may be entitled to file a claim and seek compensation. Here’s how the process typically works:

1. Determine Who Can File the Claim

Usually, immediate family members such as a spouse, children, or parents of the deceased have the legal right to file a wrongful death lawsuit. In some cases, other dependents or people financially affected by the death may also be eligible.

2. Gather Crucial Evidence

Strong evidence is essential. This can include:

  • Police accident reports
  • Medical records and autopsy reports
  • Witness statements
  • Photos or videos of the crash scene
  • Proof of financial losses (funeral costs, lost income, etc.)

3. Calculate the Damages

Compensation may cover:

  • Funeral and burial expenses
  • Medical bills related to the accident
  • Lost wages and benefits the deceased would have earned
  • Loss of companionship and emotional support
  • Pain and suffering before death

Each state’s laws define exactly what can be claimed and how much.

4. File a Wrongful Death Lawsuit

The next step is to officially file a lawsuit in civil court against the at-fault party (or their insurance company). This is separate from any criminal charges that may arise.

Important: There are strict deadlines called statutes of limitations. In California, for example, you typically have two years from the date of death to file a wrongful death lawsuit.

5. Negotiate or Go to Court

Most wrongful death claims settle through negotiations with the at-fault driver’s insurance company. However, if a fair settlement can’t be reached, the case may proceed to trial.

6. Hire Experienced Wrongful Death Attorneys

The legal process can be overwhelming while you are grieving. Experienced wrongful death attorneys can:

  • Handle paperwork and filings
  • Negotiate with insurance companies
  • Fight for maximum compensation
  • Represent you in court if necessary
