Legal Steps to Take After a Deadly Pedestrian Crash

Losing a loved one in a pedestrian accident is devastating. Beyond the emotional toll, families often face financial uncertainty and the challenge of holding the responsible party accountable. Understanding the legal process is essential to protect your rights and secure the compensation your family deserves.

1. Report the Accident and Obtain Official Records

Immediately after a fatal pedestrian accident, law enforcement should be notified so that a detailed police report can be filed. This document is critical for any future claim or lawsuit. You’ll also need the coroner’s or medical examiner’s report to confirm the cause of death.

2. Collect Evidence

Preserve any available evidence, including photos, videos, witness statements, and traffic camera footage. Your pedestrian accident lawyer in California can help gather additional records such as cellphone data, toxicology reports, and vehicle inspections to establish fault.

3. Identify the Liable Parties

The driver may not be the only one at fault. Liability can also extend to a negligent employer (if the driver was on the job) or a government entity responsible for unsafe road conditions. A qualified wrongful death attorney in California will determine who can be legally pursued for damages.

4. File a Wrongful Death Claim

Under California Code of Civil Procedure § 377.60, certain family members — such as a spouse, children, or dependents — can file a wrongful death claim. This claim allows you to seek compensation for funeral expenses, lost financial support, loss of companionship, and emotional suffering.

5. Negotiate or Litigate for Fair Compensation

Most claims settle through negotiation, but if an insurance company refuses to offer a fair amount, your attorney can file a civil lawsuit. Working with an experienced car accident law firm ensures that every legal option is pursued for maximum recovery.

6. Work with Local Legal Experts

If the accident occurred in Long Beach or surrounding areas, a local car accident attorney in Long Beach will be familiar with jurisdictional procedures, local courts, and the best strategies for achieving justice.
